1. Acceptance of these Terms

These Terms & Conditions (“Terms”) govern access to and use of the Nira by Origin website, products and related services.

By accessing the website, creating an account, placing an order or otherwise using our services, you agree to these Terms, our Shipping & Delivery Policy, Returns, Refunds & Cancellation Policy, Privacy Policy and any product-specific terms disclosed before purchase.

If you do not agree, please do not use the website or place an order.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to place an order.

A person under 18 may use the website or purchase only through a parent or lawful guardian. By ordering, you represent that the information supplied is accurate and that you are authorised to use the chosen payment method.

4. Accounts and customer information

You may be required to create an account or provide contact, billing and delivery information.

You are responsible for:

  • Providing accurate and current information;

  • Maintaining the confidentiality of account credentials;

  • Restricting access to your device and account; and

  • Informing us promptly of suspected unauthorised use.

We may rely on instructions received through your account or verified contact details unless we have reason to suspect unauthorised activity.

5. Product information

We aim to describe and photograph products accurately. However:

  • Colours may vary depending on lighting and screen settings;

  • Handmade or handwoven products may have minor variations;

  • Motif placement, weave and embroidery may differ slightly between pieces;

  • Dimensions and weights may be approximate; and

  • Packaging may change without materially affecting the product.

Such minor variations do not ordinarily constitute defects.

The product description will state, where relevant, whether a blouse piece, accessory, fall, pico, stitching or other component is included. Items shown in styled photographs are not included unless the description expressly says so.

6. Made-to-order and customised products

For made-to-order or customised products, you are responsible for supplying accurate measurements, specifications and approvals.

Production may begin once the order and required details are confirmed. Changes requested after production begins may be declined or may require additional charges and time.

Unless we expressly agree otherwise in writing:

  • Measurements will be followed as provided or approved;

  • Minor tolerances may arise from tailoring and fabric behaviour;

  • A product made according to the supplied measurements is not defective merely because the customer’s measurements later change; and

  • Customised products cannot be returned or exchanged for change of mind.

Mandatory rights concerning genuine defects or material non-conformity remain unaffected.

7. Prices, taxes and charges

Product prices and applicable taxes or charges will be displayed before order confirmation.

Prices may change without notice, but a price change will not ordinarily affect an order already accepted. If a material pricing or listing error is discovered, we may contact you for instructions or cancel and refund the order.

You are responsible for customs duties, import taxes or local charges applicable to an international order unless we expressly state that they are included.

8. Payments

Available payment methods will be displayed during checkout. Payments may be processed by independent payment-service providers and are subject to their terms and security procedures.

We do not guarantee that every payment attempt will be authorised. An order may remain unconfirmed until payment is successfully verified.

Where a failed transaction results in an account debit, the amount will be automatically refunded in full to the source account within 7 working days, subject to the processing time of the relevant financial institution.

9. Order placement and acceptance

Products placed in a cart are not reserved.

Your order constitutes an offer to purchase. We may accept or reject it for legitimate reasons, including availability, payment verification, delivery serviceability, suspected fraud or a material listing error.

An order is accepted when we send confirmation of acceptance or begin fulfilment, whichever occurs first.

We may impose reasonable quantity limits or decline orders that appear intended for unauthorised resale.

10. Order changes and cancellations

Cancellation requests are governed by our Returns, Refunds & Cancellation Policy.

In summary:

  • Ready-made orders may be considered for cancellation only before dispatch.

  • Made-to-order orders may be considered for cancellation only before production begins.

  • An accepted cancellation will be subject to a charge of 5% of the total order amount, to the extent permitted by applicable law.

  • Once dispatch or production has begun, cancellation will ordinarily not be possible.

No cancellation is effective until confirmed by us in writing.

11. Shipping, delivery and risk

Dispatch and delivery are governed by our Shipping & Delivery Policy.

Ready-made products are ordinarily dispatched within 2–5 business days. Made-to-order products are ordinarily dispatched within 2–4 weeks unless a different timeline is disclosed.

Standard shipping is free unless a charge is disclosed for a particular product, delivery method or location.

Responsibility for loss or damage passes to the customer upon completed delivery to the stated address or authorised recipient, subject to applicable consumer law and valid claims for transit damage or non-delivery.

12. Returns and refunds

Purchases are final and are not eligible for change-of-mind returns or exchanges.

This does not affect remedies required under applicable law for defective, damaged, incorrect, spurious, misdescribed or materially non-conforming goods.

13. Promotions and discount codes

Promotions, discounts and gift offers may be subject to separate conditions.

Unless expressly stated otherwise:

  • Offers cannot be combined;

  • Codes cannot be exchanged for cash;

  • A code must be applied before checkout is completed;

  • Offers may be limited by product, period, customer or availability; and

  • We may withdraw or correct a promotion affected by fraud, misuse or a material error.

A valid discount applied to an order will be reflected in any eligible refund.

14. Acceptable use

You must not:

  • Use the website for unlawful or fraudulent purposes;

  • Attempt to obtain unauthorised access to an account or system;

  • Introduce malware or harmful code;

  • Interfere with website operation or security;

  • Scrape or extract website content by automated means without permission;

  • Impersonate another person;

  • Submit false information or fraudulent claims;

  • Infringe intellectual-property or privacy rights; or

  • Use our content or products in a misleading manner.

We may restrict access where reasonably necessary to protect customers, our systems or legal rights.

15. Intellectual property

The website and its content—including the Nira by Origin name, logos, photographs, graphics, product descriptions, artwork, designs, videos, text and layout—are owned by or licensed to us and are protected by applicable intellectual-property law.

You may view and use the website for personal, non-commercial shopping purposes. You may not reproduce, publish, distribute, modify, commercially exploit or create derivative works from our content without prior written permission.

Purchase of a product does not transfer any intellectual-property right in its design, imagery, branding or related content.

16. Reviews and customer content

If you submit a review, photograph, comment or other content for public display, you confirm that:

  • You created it or have permission to submit it;

  • It is accurate to the best of your knowledge;

  • It does not violate another person’s rights; and

  • It is not unlawful, abusive, defamatory, obscene or misleading.

You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting our business, subject to applicable privacy law.

We may moderate or remove content that violates these Terms. We will not suppress genuine reviews merely because they are critical.

17. Third-party services

The website may rely on or link to third-party services, including payment gateways, courier websites and social-media platforms.

We are not responsible for independent third-party content or practices. Use of those services may be subject to separate terms and privacy policies.

18. Website availability

We aim to keep the website accurate and available but do not guarantee uninterrupted or error-free operation.

We may suspend access for maintenance, security, upgrades or reasons beyond our control. We may correct typographical, technical or listing errors when identified.

19. Disclaimer of warranties

To the fullest extent permitted by law, the website is provided on an “as available” basis without warranties beyond those expressly stated.

We do not exclude any statutory warranty, guarantee, product-liability obligation or consumer right that cannot legally be excluded.

20. Limitation of liability

To the fullest extent permitted by law, Nira by Origin will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable when the order was placed.

Where liability can lawfully be limited, our aggregate liability relating to a product or order will not exceed the amount paid for the affected product or order.

These limitations do not apply to:

  • Fraud or fraudulent misrepresentation;

  • Wilful misconduct or gross negligence;

  • Death or personal injury where liability cannot be excluded;

  • Breach of a non-waivable consumer right;

  • Product liability that cannot lawfully be limited; or

  • Any other liability that applicable law prohibits us from excluding.

21. Indemnity

To the extent permitted by law, you agree to compensate us for direct losses reasonably arising from your fraudulent or unlawful use of the website, intentional violation of these Terms or infringement of another person’s rights.

This provision does not require a consumer to indemnify us for our own breach, negligence or unlawful conduct.

22. Force majeure

We will not be liable for delay or failure caused by an event beyond our reasonable control, including natural disasters, severe weather, fire, epidemic, strike, civil disorder, governmental action, war, transport interruption, supply-chain disruption or telecommunications failure.

We will make reasonable efforts to minimise disruption and resume performance. If fulfilment becomes impossible, we may cancel the affected order and provide the refund or other remedy required by law.

23. Suspension or termination

We may suspend or terminate account access where reasonably necessary because of fraud, security risk, unlawful conduct, repeated policy abuse or a material breach of these Terms.

Termination does not affect rights or obligations that arose before termination, including payment, refund, intellectual-property and dispute-resolution provisions.

24. Governing law and disputes

These Terms are governed by the laws of India.

Subject to any consumer’s right to approach a competent consumer commission or another authority under applicable law, courts having jurisdiction in Ernakulam, Kerala will have jurisdiction over disputes relating to these Terms.

Before commencing formal proceedings, you are encouraged to contact our Grievance Officer so that we can attempt to resolve the matter.

25. Changes to these Terms

We may update these Terms to reflect changes in our services, business practices or legal obligations.

The revised Terms will be posted with an updated date. Changes will apply prospectively unless applicable law permits or requires otherwise. Terms applicable when an order was confirmed will generally continue to govern that order.

26. General provisions

If a provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect.

A delay in enforcing a right is not a waiver of that right. We may assign our rights and obligations as part of a legitimate business transfer, subject to applicable law. You may not assign an order or contractual right without our written consent where consent is reasonably required.

Headings are included for convenience and do not affect interpretation.
